Terms and Conditions.

1. About these Terms
These Terms and Conditions (“Terms”) govern the booking and provision of tutoring services by Aeries Tutoring (“we”, “us”, “our”) to you (“client”, “you”, “your”). By booking a session, enrolling in a subscription, or otherwise engaging our services, you agree to be bound by these Terms. Where a student is under 18, these Terms are agreed to by the student’s parent or legal guardian, who is responsible for compliance with them.
2. Our services
We provide secondary school tutoring services for students in Years 7–12, including ATAR preparation, across a range of subjects. Sessions are delivered either online (via video call) or in person, as agreed between you and your tutor.
3. Bookings
Sessions are booked through our website or by direct arrangement with us. A booking is confirmed once it has been accepted by us and, where applicable, payment arrangements have been set up. We will try to accommodate preferred tutors, times, and locations, but availability cannot be guaranteed.
4. Fees and payment
Our tutoring fees operate on a recurring subscription basis. You are only charged for sessions that are actually delivered - if a scheduled session is skipped or does not go ahead, you will not be charged for it. Current fees are available on our website and may be updated from time to time; we will give you reasonable notice of any fee changes before they take effect.
All payments are processed securely through our third-party payment processor, Stripe. We do not store your full card details on our own systems.
If a payment fails, we will let you know and allow a short grace period of 7 days to resolve it. If the payment issue is not resolved within that time, we may suspend future bookings until the outstanding amount is paid.
5. Cancellations and rescheduling
You may cancel or reschedule a session at any time, free of charge, and no notice is required. That said, we appreciate at least 12 hours’ notice where possible, as it helps your tutor plan and may make it easier to offer the session time to another student. Because you are only charged for sessions that go ahead, a cancelled or skipped session will not be billed.
If we need to cancel or reschedule a session on our end (for example, due to tutor unavailability), we will let you know as soon as practicable and offer a suitable alternative time.
6. Refunds
As you are only charged for sessions that are actually delivered, there is generally nothing to refund for sessions that are cancelled or skipped. Once a session has been completed, it is not eligible for a refund. This does not affect any consumer guarantee, right, or remedy that cannot lawfully be excluded under applicable Australian law (see section 14).
7. Client responsibilities
To help sessions run smoothly, you agree to:
- provide accurate information about the student’s year level, subjects, and any learning needs relevant to tutoring;
- ensure the student attends sessions on time and is prepared with any required materials or a working device/internet connection for online sessions;
- ensure a safe, appropriate, and reasonably quiet environment for in-person and online sessions; and
- treat tutors and staff respectfully and courteously.
8. Online sessions
Online sessions are conducted via Google Meet. You are responsible for ensuring the student has access to a suitable device, a stable internet connection, and any required software. We are not responsible for session disruptions caused by technical issues outside our control, though we will work with you to reschedule where reasonably possible.
9. In-person sessions
In-person sessions may take place at a tutor’s home, a client’s home, or another agreed location, depending on what is arranged for each booking. Where a session takes place at a private residence, both parties agree to take reasonable care for the safety and comfort of everyone present.
10. Conduct and safety
All of our tutors hold a current Working with Children Check, in accordance with Western Australian law.
We are committed to providing a safe and respectful learning environment for all students. We may decline to provide services, or end a tutoring arrangement, where a client’s or student’s conduct is abusive, unsafe, or otherwise unreasonable. Any concerns about a tutor’s conduct should be raised with us directly using the details in section 16.
11. Educational outcomes
While our tutors are committed to supporting each student’s learning, we do not guarantee specific academic results, grades, or ATAR outcomes. Tutoring is one part of a student’s overall learning, and outcomes depend on many factors outside our control, including the student’s own engagement and effort.
12. Intellectual property
Any worksheets, resources, question banks, or other materials we provide are for the personal educational use of the enrolled student and their family only. They may not be copied, distributed, or shared with others, or used for any commercial purpose, without our prior written consent.
13. Privacy
Our collection and handling of personal information is set out in our Privacy Policy, available separately on our website. By engaging our services, you acknowledge that you have read and understood our Privacy Policy.
14. Limitation of liability
To the maximum extent permitted by law, our liability to you arising from or in connection with our services is limited to the value of the fees paid for the relevant session(s). Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot lawfully be excluded under the Competition and Consumer Act 2010 (Cth) or any other applicable law.
15. Changes to these Terms
We may update these Terms from time to time. Updated Terms will take effect once posted on our website, and we will take reasonable steps to notify you of any significant changes. Continuing to use our services after changes take effect means you accept the updated Terms.
